(Legally detailed version – differentiated between B2B and B2C)
§1 Scope of application
These General Terms and Conditions apply to entrepreneurs (B2B) and consumers (B2C) in accordance with the Austrian Consumer Protection Act (KSchG).
§2 Subject matter of the service
The subject matter is brokerage consulting. Success in obtaining official approval (visa, RWR card, nostrification) is not guaranteed.
§3 Contingency fee – graduated model
Remuneration is based on the individual agreement. Unless otherwise agreed, invoices are due within 14 days net without deduction.
In the event of late payment, the statutory default interest pursuant to § 456 UGB (Austrian Commercial Code) shall apply.
§4 International candidates (third countries)
The client is expressly advised that:
work and residence permits are subject to independent decisions by the authorities there is no guarantee of visas or RWR cards
§5 Cancellation and withdrawal
Before candidate presentation: free of charge
After presentation: 30% of the agreed fee
After signing the contract: 100% success fee
Authority and translation costs are to be reimbursed regardless of success.
§6 Liability
B2B
Liability only in cases of intent or gross negligence. Maximum liability amount: twice the net fee.
B2C
Liability in accordance with § 1295 ABGB (Austrian Civil Code); restrictions only to the extent permitted by law.
No liability for:
Official decisions
Indirect damages
Lost profits
§7 Statute of limitations
Claims for damages expire within 12 months of knowledge, but no later than within 3 years.
§8 Force majeure
In the event of force majeure (e.g., changes in legislation, entry restrictions, official delays), the obligation to perform shall be suspended.
§9 Data protection & consent
By signing the agency agreement, the applicant expressly declares their consent in accordance with Art. 6 (1) (a) GDPR to the processing and transfer of their data.
Revocation is possible at any time.
§10 Place of jurisdiction
B2B: competent court in Tyrol. B2C: place of jurisdiction in accordance with the Consumer Protection Act (KSchG).
